Terms and Conditions

These terms and conditions (the “Terms and Conditions”) apply to all sales of Eco solar vents product or products (the “Product”) sold remotely through the website www.ecosolarvents.com.au (the “Website”).
The Terms and Conditions constitute the entire Agreement between (“us” / “we” / “our”) and those parties who purchase Product through the Website (the “Customer”).
The Customer by placing an Order for Product through the Website is taken to have read, understood and accept these Terms and Conditions.
The Terms and Conditions are subject to the laws of Australia and any dispute with respect to these Terms and Conditions are subject to the jurisdiction of the Courts of Western Australia.
The Customer if a natural person warrants that they over eighteen (18) years of age and legally capable of entering into a legally binding contract.

The Customer undertakes there will be a 7 day cooling off period on all products, after no provision in our Returns Policy for Products which is not suitable to the Customer for reason of noise or sound will receive a full refund. Replacement or parts (motor) can be arranged. 5 Year warranty will repair or replace the products only.
Upon the completion and verification of an Order through the Website, the Customer is bound to purchase the ordered Product as authorized by the Customer.

The Websites provides information to Customers of essential features and pricing of the various Product available for sale.
All prices for Product are contained on the Website and may vary due to sale prices.
Upon completion of the Order the Customer agrees that they are subject to these Terms and Conditions and that the ordered product will be delivered.
The Customer understands that the Customer may only change their online instructions to us prior to completing the Order.
Once a Customer has completed an Order on our website and payment has been received by us, the Customer cannot cancel the Order.
We reserve the right to cancel the Order after being placed by the Customer in the event that the materials used to manufacture the Product become unavailable or our manufacturing capabilities are compromised for whatever reason. In the event that we cancel an Order for this reason a full refund of the purchase price will be made to the Customer without deduction and we will notify the Customer of the cancellation by email transmission.
Upon acceptance of the Order by us, we will send to the Customer a Tax Invoice and final Product specification detail

All prices on the Website are in Australian dollars ($AUS).
Pricing is subject to change by us from time to time, but we will complete delivery of the Product to the Customer at the price that the customer is quoted.
We do not represent to the Customer that we will supply to the Customer the same Product in the future at the same price, if we change the price advertised on the Website before the Customer places their future order.
Product prices on the Website do not include cost of delivery which cost is outlined on the Website in the purchasing process and disclosed to the Customer prior to completion of the Order.
We constantly check that the pricing information on our Website is accurate however we cannot guarantee the absence of errors. In the event of a pricing information error on the Website we will give the Customer the option to reconfirm the Order at the correct price or to cancel the Order.

Payment for our Product may be made by Visa or bank Transfer with the ANZ bank
The transaction will be charged to the credit card of the Customer only when:
the credit card data has been verified;
the debit authorization has been received from the issuer of the credit card used by the Customer; and
We agree to pay and not charge the Customer for any bank fees or charges of our bank in processing payment of the Order. The Customer agrees to pay any bank fees and charges of their bank in processing payment of the Order.
If payment of the Order amount is unsuccessful, for whatever reason, the Order will be cancelled immediately.
An Order will not be considered complete and we do not accept the Order until we have received payment from the Customer for the Product.
Late Payments Fees,
Late payment fee and account keeping fee of $50.00 will be charged per month after 90 day of installation date. All legal fees will be charged to the outstanding account if it’s not paid after 120 days of the installation day.

On completion of the Order of Eco solar vents or whirlybirds and once the Product has been packaged ready for delivery, we will by email transmission forward to the Customer a Delivery Note outlining our courier details, date of departure for our manufacturer and a tracking number.
The cost of Delivery is at the cost of the Customer and is paid on completion of the Order.
We undertake only to use reputable courier companies who provide an online tracking system.
It is the responsibility of the Customer to track delivery of the Product and to notify us in the event that the Product is not delivered within a reasonable timeframe.
It is the responsibility of the Customer to notify us in the event that the Product is delivered to the Customer and the number of packages outlined on the Delivery Notes is not received or the delivered packages are not intact, wet or damaged.
On delivery of the Product to the Customer, the Contract between the Customer and us is concluded.

Information with respect to Products, Eco solar vents and whirlybirds sold by us is available on the Website.
The images of the Product available on the Website are photographs of actual Product that we have previously manufactured and may appear different to the Customer on delivery through imagery perception.
We undertake to provide constantly updated information on our Website, however the complete absence of errors cannot be guaranteed. The Website may contain errors, inaccuracies or omissions and we reserve the right to correct any errors, inaccuracies or omissions even after the Order has been completed. We also reserve the right to change or update our Website at any time without Notice to a Customer with a pending Order.
We reserve the right to advertise Whisper Quiet on our products that do operate at a sound no greater then 50 Decibels. New 2020 motors have no motor sound

If a Product on delivery shows a manufacturing defect we will provide to the Customer a full refund of the purchase price subject to our Returns Policy.
5 year warranty will repair or replace the product if its stops working under normal weather conditions. Eco solar vents will pay for the products only or parts needed to fix the product. Labour cost will be paid for buy the client, not Eco solar vents.
Product warranty does not include storm damage or flying objects smashing the product.
Product warranty does not include fan noise of the product under normal working conditions.
Eco solar vents Product Warranty does not cover motor noise from units install before 2020. Eco solar vents are a powered unit and have a powered fan so they will operate with a noise or will operate with a noise of a fan inside your roof.
With a ceiling above the sound will be whisper quiet while its operation is under full sunlight, but due to different people’s noise tolerance and ceiling insulation this could sound louder or there could be no sound at all. New 2020 motors have no sound now! so they are very hard to hear. We also have switches available to give people full control of the Eco solar vent.
The Eco solar vents run from the power of the sun. this will change the fan speed and the sound of the fan, example full sunlight to cloudy patches. This is normal and the sound will change.
Eco solar vents will not do free solar vent inspections to tell you if or if not your solar vent is working. but you can pay $150.00 for this service and we will service the unit and replace the motor.
Roof Leaks Warranty.
1. We are fully Insured. We will fix any roof leak for up to 5 years after installation but if extra over flashing is required, we will need to charge for this.
2. If the roof leak is caused by not installing an over flashing, we will not be responsible for the roof leak. We will always tell you if an over flashing is required and extra charges will apply for the cost and instillation for an over flashing. This is due to different types and colours of roofs and the over flashings will need to be made to order. With the correct over flashing the roof is 100% water tight.
3. We will Give 30 days’ Warranty (30 days after the installation date on the invoice) for roof leaks. We give a 100 % chance that if installed under the top ridge, tile, or under an over flashing that you should not get a roof leak. If you install down the roof with a silicon join, this will one day leak.

We guarantee the authenticity of all our Eco solar vents and whirlybirds which are made using only the finest available materials.
All intellectual property rights of our Product remain our exclusive property and the Customer warrants and agrees not to infringe those rights.

Eco solar vents warranty will not cover cosmic storms from space, sun burst that wipes out electronic equipment.
Eco solar vents warranty will not cover any type of Unforeseen circumstances that is a once in a lifetime event that causes damage to the Eco solar vent.
Sun Burst, Hail Storms, or any Rear Weather event that wipes out a large number of the Eco solar vents, the warranties will not be valid.
